Terms and Conditions

Any person (“User”, “Customer”, “you”, or “your”) who visits, browses, accesses, inquires about, or books any products, travel packages, or services offered by Ternigo through our Website, sales executives, travel experts, messaging platforms (including WhatsApp), call centers, or offline offices agrees to be strictly bound by these Terms, our Privacy Policy, and our Cancellation & Refund Policy.

If you do not agree with any part of these Terms, you must immediately discontinue using our Platform and refrain from availing any services facilitated by Ternigo. All rights and liabilities of the User and Ternigo with respect to any service or product facilitated by Ternigo shall be strictly restricted to the scope defined under these Terms.

Ternigo acts as an aggregator, travel planner, and facilitator connecting Users with third-party service providers (“Service Providers”) such as airlines, hotels, resorts, destination management companies (DMCs), activity operators, cruise lines, and ground transport vendors.

• Contractual Relationship: Ternigo facilitates bookings and customizes travel itineraries. However, the ultimate contract of service for travel execution (e.g., flight carriage, hotel stay quality, transfer execution) is directly between the User and the respective Service Provider.
• Scope of License: Ternigo grants the User a limited, non-exclusive, non-transferable, revocable right to access and use the Platform for personal, non-commercial purposes. The User agrees not to interrupt, alter, or attempt to interrupt the operation of the Platform in any manner whatsoever.

• Age & Legal Capacity: The Platform is intended solely for bonafide individual travelers who are at least 18 years of age and capable of entering into legally binding contracts under the Indian Contract Act, 1872. If you are under 18 years of age, you may use the Platform only under the supervision and consent of a parent or legal guardian.
• Bar on Travel Agents & Commercial Resellers: Unless explicitly authorized in writing by Tourvana Trips Private Limited under a formal business partnership agreement, all commercial travel agents, tour operators, consolidators, and resellers are strictly barred from using our B2C Platform or consumer promotional offers for resale or commercial gain.
• Account Action: Ternigo reserves the right to cancel bookings and terminate accounts immediately without prior notice if it is discovered that a booking was made by a minor or an unauthorized travel reseller. Any commercial loss or cancellation fee arising from such unauthorized bookings shall be borne entirely by the breaching party.

By providing your contact details (phone number, email address, WhatsApp number) on our Platform or to our travel experts, you expressly consent to receive transactional and promotional communications from Ternigo.

• Communication Types: These communications include booking updates, OTP login codes, itinerary quotes, flight/schedule change notifications, payment receipts, feedback requests, and promotional travel offers.
• Mediums: Updates may be delivered via SMS, WhatsApp, automated/non-automated phone calls, push notifications, and emails.
• Override of DND / NCPR: You acknowledge that these communications are transactional and directly related to your inquiry or trip. Your consent under these Terms explicitly supersedes any registration set by you under the National Customer Preference Register (NCPR) or Do Not Disturb (DND) registries.

User Conduct Rules: When communicating with Ternigo staff or posting content on our Platform, you agree NOT to use language or upload material that is:

• Abusive, threatening, defamatory, harassing, obscene, vulgar, or hate-oriented;
• In violation of third-party intellectual property or privacy rights;
• Commercial spam, phishing, or malicious code/software;
• Contrary to any applicable local or international laws.

When you log into the Ternigo Platform or request an itinerary quote using your mobile number, you agree to receive a One-Time Password (OTP) or authentication verification code via SMS or WhatsApp.

• Verification codes are sent on a per-request basis to authenticate your identity.
• Standard messaging and data rates imposed by your mobile network operator may apply.
• Ternigo uses your contact number strictly for service delivery and security authentication. We do not sell or trade your personal mobile details to third parties for independent marketing purposes.

• Ownership: All content on the Platform—including but not limited to text, graphics, logos, icons, custom itinerary templates, software code, UI design systems, branding, audio clips, and media—is the exclusive property of Tourvana Trips Private Limited and is protected under applicable Indian and international copyright, trademark, and intellectual property laws.
• Restrictions: You shall not copy, reproduce, modify, distribute, sell, license, reverse engineer, or exploit any content or software from the Platform for commercial or public purposes without express prior written permission from Tourvana Trips Private Limited.
• Reporting Infringements: If you believe any content on our Platform infringes your intellectual property rights, please send a detailed notice to support@ternigo.in.

• Government Taxes & Statutory Levies: Any increase or revision in applicable government taxes (GST, TCS under Liberalised Remittance Scheme), airport fees, park entrance fees, visa processing fees, or fuel surcharges levied by authorities after booking confirmation must be paid in full by the Customer.
• Exchange Rate Fluctuations: For international travel packages, price estimates are calculated using real-time foreign exchange rates. Ternigo reserves the right to adjust final invoice balances prior to full payment if significant currency fluctuations occur.

Ternigo strives to deliver verified, high-quality travel experiences. However, as an aggregator and travel studio facilitator, Ternigo’s liability is strictly governed as follows:

• Scope of Service: Ternigo’s obligation is limited to providing a valid, confirmed booking voucher as selected and paid for by the User.
• Service Provider Failures: Ternigo shall not be liable for any service deficiencies, delays, flight cancellations, hotel room quality issues, personal injury, property loss, or operational changes caused by third-party Service Providers (airlines, resorts, DMCs, local transport drivers).
• Insolvency of Travel Partners: Ternigo shall not be held liable to refund or compensate Users in events where a third-party airline, hotel chain, or DMC ceases operations, declares insolvency, or enters bankruptcy proceedings.
• Cap on Total Liability: Under all circumstances, the maximum cumulative liability of Tourvana Trips Private Limited for any direct claim or loss arising out of a booking shall be capped at the actual amount received by Ternigo from the User for that specific booking.

• Travel Documents: It is the sole responsibility of the traveler to ensure they possess valid travel documents, including passports (with minimum 6 months validity from return date), valid visas, transit visas, health certificates, and mandatory government travel authorizations. Ternigo is not liable for boarding rejections or deportation resulting from invalid documents.
• Accuracy of Information: The User guarantees that all personal details (names as per passport, dates of birth, contact numbers) provided during booking are accurate. Any airline name-change penalties or ticket re-issuance fees resulting from incorrect data provided by the User shall be borne entirely by the User.
• Account Security: Users are responsible for keeping their login credentials, passwords, and payment OTPs confidential. Ternigo will never ask for your card CVV or banking password over calls or messages.

• Cancellation Terms: All cancellations and modification requests must be submitted in writing to support@ternigo.in or through your dedicated Ternigo travel advisor.
• Supplier Policies Apply: Cancellations and refunds are strictly subject to the specific cancellation policies of the underlying Service Providers (airlines, hotels, DMCs). Non-refundable flight fares and peak-season hotel bookings cannot be refunded.
• Modification Caps: Confirmed itineraries can be modified up to a maximum of two (2) times prior to final voucher issuance, subject to supplier availability and fare difference payments. Subsequent modification requests may attract additional processing charges or be treated as a fresh booking.

• Ternigo may, at its discretion, issue promotional credits or refund values into a user's digital Ternigo Wallet.
• Wallet credits are non-transferable, non-encashable, and cannot be withdrawn into a bank account.
• Promotional wallet credits carry specific validity periods and percentage usage caps per booking, as displayed on the Platform. Expired wallet credits cannot be reinstated.
• Domestic and international wallet balances must be utilized strictly against their respective designated travel categories.

Neither Tourvana Trips Private Limited nor the Service Providers shall be held liable for failure or delay in fulfilling travel bookings due to events beyond reasonable control (“Force Majeure”). Force Majeure includes, but is not limited to:

• Acts of God, floods, earthquakes, natural disasters, severe weather conditions;
• Pandemics, epidemics, government-declared lockdowns, border closures, travel advisories;
• Wars, civil unrest, terrorist activities, strikes, labor disputes, airport closures;
• Technical outages, national payment gateway disruptions, or power grid failures.

In Force Majeure scenarios, refunds (if any) shall depend entirely on the recovery of funds from third-party airlines and suppliers, and may be provided in the form of credit shells or future travel vouchers as dictated by supplier policies.

Ternigo reserves the right, at its sole discretion, to reject any inquiry or cancel a booking without prior notice if:

• The transaction is flagged for suspected credit card fraud, identity theft, or unauthorized reseller activity;
• The User breaches these Terms, engages in abusive behavior toward staff, or provides false identification;
• Directed by law enforcement, judicial courts, or government bodies.

The User agrees to defend, indemnify, and hold harmless Tourvana Trips Private Limited, its directors, officers, employees, travel experts, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

• User’s breach of these Terms or violation of any applicable law;
• User’s infringement of any third-party intellectual property or privacy rights;
• Any misrepresentation of facts or invalid documentation provided during the booking process.

• Governing Law: These Terms, all transactions, and any dispute arising between the User and Tourvana Trips Private Limited shall be governed by and construed in accordance with the laws of India.
• Mediation: Prior to initiating litigation, both Parties agree to attempt to resolve any dispute or claim through good-faith online or offline mediation.
• Jurisdiction: If mediation fails, the Parties agree that any legal proceedings or court claims shall be subject to the exclusive jurisdiction of the competent courts in Delhi India.

• Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be severed, and the remaining provisions shall continue in full force and effect.
• Entire Agreement: These Terms, together with the Privacy Policy and booking voucher conditions, constitute the entire agreement between the User and Tourvana Trips Private Limited regarding the use of the Platform.
• No Physical Signature Required: The User acknowledges and agrees that no physical or digital signature is required to make these Terms binding. Continued use of the Platform signifies full acceptance of these Terms.
